A traffic stop by a Clay County Deputy lands a Calumet man in the Clay County
jail on traffic and drug charges.
A Clay County Deputy initiated a traffic stop on a vehicle in the 4000th block
of 150th avenue. Upon investigation, the deputy determined that the driver,
Michael Shriver, 46, of Calumet, IA, had been drinking. The deputy then
conducted several field sobriety tests on Shriver and the results of the tests
determined that Shriver was intoxicated. Shriver was placed under arrest. The
Clay County K-9, Max, and K-9 handler, Deputy Zach Larsen, were notified to
assist on the traffic stop to conduct a K-9 search of the truck. Upon conducting
a vehicle search, a small amount of marijuana and drug paraphernalia were
located. Shriver was transported to the Clay County Jail w/o incident. Upon
arrival to the jail, Shriver was charged with O.W.I. (3rd), a class “D” felony,
Possession of a Controlled Substance-Marijuana, a serious Misdemeanor,
Possession of Drug Paraphernalia, and No Proof of Insurance, both simple
misdemeanors. Shriver was held in the Clay County Jail to appear before the
magistrate.
The Clay County Sheriff’s Office is participating in the 5th and final wave of
Step (special traffic enforcement program). This wave is in conjunction with the
National Drunk Driving Campaign “Over the Limit. Under Arrest.”
This year the Clay County Sheriff’s Office completed its 13 year participating
in the step program. Each year has been very successful in making drivers and
passengers aware of the seatbelt laws. At one point this year, Clay County
reached a 96% usage rate.
This wave began August 18th and will run through August 31st. Reminder to all
drivers and passengers to buckle up. The fine for Failure to use seatbelt is $88
in Clay County.

Details of Arrest: A 17 YEAR OLD JUVENILE WAS ARRESTED FOLLOWING A TRAFFIC STOP
FOR SPEED IN THE 3700 BLK OF HWY 71. IT WAS DETERMINED AFTER AN INVESTIGATION
THAT THE DRIVER WAS DRIVING UNDER THE INFLUENCE OF ALCOHOL. AN ADMINISTRATIVE
REVOCATION WAS DONE ON HER DRIVER’S LICENSE FOR AN .02 VIOLATION. IT WAS ALSO
DISCOVERED THAT THE VEHICLE SHE WAS TAKEN WITHOUT PERMISSION OF THE OWNERS IN
SPENCER. BAXTER WAS THEN CHARGED FOR OPERATION WITHOUT OWNERS CONSENT AN
AGGRAVATED MISDEMEANOR, FOR TAKEN THE VEHICLE. BAXTER WAS ALSO CHARGED WITH
SPEED, AND MINOR IN POSSESSION OF ALCOHOL. BAXTER WAS CITED INTO JUVENILE COURT

On Saturday, 08-16-08, at approximately 12:26 a.m., a Clay County Deputy stopped
a vehicle in the 10 block of West 1st Street, in Spencer. The Deputy discovered
all three occupants had open containers of alcohol in the vehicle. A further
search of the vehicle, by the Clay County Deputy and a Spencer Police Officer
revealed that the driver was in possession of Marijuana and Drug Paraphernalia.
Officer’s also located a large amount of marijuana, cash and items used to weigh
and distribute marijuana in the vehicle. All three subjects were taken into
custody and were placed in the Clay County Jail.
The driver, Joel Alexander Eli Miller, age19 was charged with:
-Possession Controlled Substance with Intent to Deliver- Class “D” Felony
-Violation Drug Tax Stamp- Class “D” Felony

A traffic stop by a Clay County Deputy lands a Minnesota man in the Clay County
Jail on traffic and drug charges.
At approximately 1823 hrs on the 15th day of August, 2008, a Clay County Deputy
initiated a traffic stop on a vehicle for a traffic violation. Upon making
contact with the driver, Mark Gruben, 47, of Freeborn, Minnesota, the deputy
observed an open can of beer and also noticed an odor of an alcoholic beverage.
The deputy had Gruben step out and had him perform several field sobriety tests.
The deputy determined that Gruben was operating while intoxicated. Gruben was
placed under arrest. A search of the vehicle turned up approximately ¼ of an
ounce of marijuana and drug paraphernalia. Gruben was then transported to the
Clay County Jail.
Gruben was charged with O.W.I. (1st), a serious misdemeanor, excessive Speeding
(62-35), a simple misdemeanor, Open Container-driver, a simple misdemeanor,
Possession of a Controlled Substance-Marijuana, a serious misdemeanor, and
Possession of Drug Paraphernalia, a simple misdemeanor. Gruben was held in jail
to appear before a magistrate.

A traffic stop lands 5 men in the Clay County Jail. At approximately 1808 hrs on
the 13th day of August, 2008, a Clay County Deputy initiated a traffic stop on a
vehicle for a traffic violation. Upon investigation, it was found that the
driver, Jacinto Guerrero-Lopez, 25, of Springfield, Missouri, didn’t have a
valid drivers license. The deputy also noticed an open container of beer on the
passenger side of the vehicle. At this time the deputy then had the 5 males step
out of the vehicle and upon a search of the vehicle, the deputy found 3 more
open containers of beer.
The passengers were then identified as Jose Suaste-Palomino, 20, of Springfield,
Mo., Isaias Lopez-Montalban, 19, of Chattanooga, Tn., Nicolas Govea-Morales, 22,
of Springfield, Mo., and Ronald Saucedo, 38, of Springfield, Mo. All males were
placed under arrest and were transported to the Clay County Jail w/o incident.
The driver, Guerrero-Lopez, was charged with Failure to Have a Valid Drivers
License and Excessive Speed, Both simple misdemeanors. Suaste-Palomino and
Lopez-Montalban were both charged with Open Container-passenger and for Underage
Alcohol Possession, both simple misdemeanors. Govea-Morales and Saucedo were
both charged with Open Container-passenger, both simple misdemeanors. All 5 men
were released on a $300.00 cash bond.

O'Kelley was southbound on 250th Avenue and lost control of the pick up. Pick up
entered west ditch, hit and spun the front end up onto the roadway. Roth was
ejected through rear window and came to rest in ditch.

A traffic stop by a Clay County Deputy lands two
Clay
County residents in jail.
At approximately 23:05 hrs on Wednesday, August 6, a Clay County Deputy
initiated a traffic stop on a vehicle with prior knowledge that the owner of the
vehicle, Jamil Conley, 24, of Everly, and passenger Mercedes Johnson, 18, of
Everly were wanted on Clay County Warrants.
Both individuals were placed under arrest and transported to the Clay
County Jail for Booking. Jamil Conley and
Mercedes Johnson were charged with Possession of a Controlled
Substance-Marijuana, a serious misdemeanor, and Possession of Drug
Paraphernalia, a simple misdemeanor.
A traffic stop by a Clay County Deputy lands two Clay
County
men in the Clay County Jail on traffic and drug charges.
At approximately 1123 hrs on the Wednesday, the 6th day of
August 2008, a Clay County Deputy initiated a traffic stop on a vehicle with
having prior knowledge that the driver, Travis Stoyke, 34, of Spencer, Iowa,
had a suspended drivers license.
Stoyke was placed under arrest.
Upon further investigation, it was found that the passenger, Curtis
Paine, 37, of Spencer, Iowa,
was in possession of drug paraphernalia and of a small amount of marijuana.
Paine was also placed under arrest.
Stoyke and Paine were both transported to the Clay County Jail without
incident. Stoyke was charged with Driving
Under Suspension and No Proof of Insurance, both simple misdemeanors.
Paine was charged with Possession of a Controlled Substance-Marijuana, a
serious misdemeanor, and Possession of Drug Paraphernalia, a simple misdemeanor.
Stoyke and Paine were both held in the Clay County Jail to appear before
the Judge.

At approximately 16:34 on July 29, 2008 Clay County Deputies responded to a 2
car head on collision at the intersection of hwy 18 and M-27. Upon investigation
deputies learned that Mrs. Dekok was attempting to make a left hand turn into
Barb's Restaurant and did not see Mr. Heida traveling westbound. Both cars
collided Head on. Mr. Heida and Mrs. Dekok were transported to Spencer Hospital
for further evaluation. Clay County Deputies were assisted by Everly Fire and
Rescue and Spencer Rescue

STOP ON THE OTHER SIDE WITHOUT INCIDENT. AFTER AN INVESTIGATION ON SCENE IT WAS
DISCOVERED THAT MICHAEL A MARKEY WAS DRIVING A MOTOR VEHICLE WHILE INTOXICATED.
MARKEY WAS ARRESTED AND WAS TAKEN TO THE CLAY COUNTY JAIL WITHOUT INCIDENT. IT
WAS ALSO DISOCVERED THAT THERE WAS DRUG PARAPHERNALIA IN THE BACK SEAT OF THE
VEHICLE. MARKEY WAS CHARGED WITH THE OWI, POSSESION OF DRUG PARAPHERNALIA, AND
PCS MARIJUANA DUE TO SOME STILL BEING IN THE DRUG PARAPHERNALIA. THE TRAFFIC
CHARGES WERE RECKLESS DRIVING, FAIL TO OBEY A STOP SIGN, AND DRIVING THE WRONG
WAY ON A ONE WAY HWY. MARKEY WAS BOOKED INTO THE CLAY COUNTY JAIL WITHOUT

Details of Complaint: The Spencer Communications Center received a call that
several people were fighting near the front door of Sneakers Lounge. Upon
officers arrival 5 people were located at the front entrance to the bar. After
further investigation it was determined that there had been a physical
altercation between several subjects. None of these subjects wanted to press
charges. Also during the investigation one of these subjects became
uncooperative towards a Clay Co Deputy and was arrested. This subject was
identified as William Hill. Hill was taken to the Clay County Jail were he was
booked in for public intoxication and held to appear before the magistrate. No
other charges were filed in this incident. The Spencer Police Department was
assisted by the Clay County Sheriff’s Office.
